May 11, 2011, CMS Policy Memorandum: This memorandum provides no substantive changes to policy, but reiterates the MSA review thresholds set forth at the link above, emphasizing that the thresholds do not create a “safe harbor” in cases that do not meet the thresholds but only serve as a cut-off to control CMS work load. The parties still must consider Medicare’s interest in all cases, regardless of settlement amount: settlements that do not meet the thresholds still may require the inclusion of an MSA without the availability of CMS review. The memorandum also is a reminder that the review thresholds are subject to change.

Alert: The Medicare Secondary Payer Recovery Contractor (MSPRC) has temporarily suspended the issuance of Rights and Responsibilities (RAR) letters and the Demand for Repayment letters. This alert can be found on the MSPRC’s web site: http://www.msprc.info.
Alert from the Medicare Secondary Payer Recovery Contractor (MSPRC) dealing with changes in the procedure for handling "conditional payments" made by Medicare:
"Effective for cases established on or after October 1, 2009, the "Right to Recovery Letter" issued when a claim for liability insurance (including self-insurance), no-fault insurance, or workers’ compensation is reported to CMS’ Coordination of Benefits Contractor (COBC) will no longer be issued by the COBC. The letter has been revised, renamed (it is now the "Medicare Secondary Payer Rights and Responsibilities" letter) and will be issued by the MSPRC.
Note: If you received a "Right to Recovery Letter" issued by the COBC and dated on or before September 30, 2009, you may follow the instruction in that letter regarding submitting a "Consent to Release" document."
The "Medicare Secondary Payer Rights and Responsibilities" letter is intended for the insurance claimant/Medicare beneficiary to explain Medicare’s right to recover payments that it believes should have been paid by the insurer in a reported claim. Thereafter, a "Conditional Payment Letter" will be sent to all parties by the MSPRC setting forth an initial summary of conditional payments. From that point, an insurer or self-insurer may obtain additional conditional payment information by submitting a request to the MSPRC. A "Consent to Release" form signed by the claimant/Medicare beneficiary must be used by liability insurers and self-insurers, but should not be necessary in workers’ compensation and no-fault insurance cases. A "Carrier Letter of Authorization" must be used where the insurer or self-insurer uses an outside entity to handle the conditional payments procedure.
A sample of the "Consent to Release" form can be found at http://www.msprc.info/forms/ConsenttoRelease.pdf. The "Carrier Letter of Authorization" should be on the insurer’s or self-insurer letterhead; indicate that the designated entity has been retained as an agent to obtain conditional payment information and interact with the MSPRC; include the claimant’s/Medicare beneficiary’s name, accident date, and HICN (if known); and specify the nature of the services for which the designated entity has been retained. Entities that offer these services likely will have form letters available for placement on the insurer’s letterhead.
